What Counts As A Violation In An Alcohol Interlock Program?

When you’re navigating the conditions of an alcohol interlock program, there’s no room for confusio–especially when your ability to drive depends on it. These programs are designed to promote safer roads by preventing drink driving, requiring drivers to pass a breath test before their vehicle can start.

At Guardian Interlock, we’ve helped thousands of drivers meet their court or licence conditions with straightforward, reliable interlock technology. But despite how clear the process may seem, one question often trips people up: what actually counts as a program violation?

Understanding this is crucial–not just to stay compliant, but to avoid costly penalties or extended time on the program. That’s why we’ve made it easy for you and have broken it down so you know exactly what to watch out for.

What Counts As A Program Violation?

When you’re part of an alcohol interlock program, every action matters. A program violation isn’t just a technical slip–it can delay your progress, trigger legal consequences, or even extend your time in the program. Let’s break down the most common types of violations and what they mean for you.

a. Failed Breath Test

If you provide a breath sample and the device detects alcohol above the legal threshold of 0.02, the interlock will log this as a failed test which may lead to a program violation, dependant on your program rules. The interlock will also be immobilised for a period. Program violations can lead to an extension of your period program.

b. Missed or Refused Tests

Refusing to provide a breath sample when prompted–either before starting the vehicle or during a rolling retest–counts as a program violation. Even if you turn off the car to avoid a test, it will still be logged as a refusal. Attempts to delay or dodge a test are treated just as seriously as failing one. Always ensure you take a requested retest even if you’ve reached your destination.

c. Rolling Retest Failures

Alcohol interlock devices often require rolling retests while you’re driving. Ignoring or failing to complete these retests within the required time window is considered a program violation. It shows non-compliance and may result in increased monitoring or penalties. Always ensure you take a requested retest even if you’ve reached your destination.

d. Device Tampering or Circumvention

Trying to trick, tamper with, or disable the device in any way–like using a balloon, having someone else blow into it, or disconnecting the system–is a serious program violation. These actions can lead to legal consequences, including suspension from the program, fines, or court action.

e. Missing Scheduled Service Appointments

Alcohol interlock devices must be serviced regularly–usually every 30 to 60 days, depending on your state’s rules–to ensure they’re working correctly and to download your usage data. Missed appointments will trigger a device lockout after 7 days, meaning your vehicle won’t start until the unit is serviced. To unlock the unit you will be required to purchase a code to return for service. It may also extend the duration of your alcohol interlock program and result in additional fees.

How Many Interlock Violations Can You Have Before It Affects Your Program?

While alcohol interlock programs are designed to support safe driving habits, repeat violations can quickly turn your progress into a setback. Most state programs allow for a limited number of violations–typically one or two–before consequences start to apply. However, it’s important to note that the exact thresholds vary by state, so staying informed about your local guidelines is crucial.

If you exceed the allowable number of violations, you could face program extensions, licence suspension, or even disqualification, delaying your return to unrestricted driving.

At Guardian Interlock, we make it easier to stay on track. With user-friendly technology, clear test prompts, and automatic reminders for service appointments, we help reduce the risk of accidental violations. Our goal is to keep you moving forward, not set you back.

What To Do If You Receive A Program Violation Notice

Getting a violation notice in your alcohol interlock program can be stressful, but it’s not the end of the road. Whether it was due to a missed test, a failed reading, or a tampering alert, it’s important to take action quickly and responsibly.

First, don’t ignore the notice. Program authorities take violations seriously, and failure to respond could lead to extended licence restrictions or removal from the program altogether. Review the details of the violation to understand exactly what happened and when. You should also request to complete an occurrence report at your next service so this can be noted on your account for future reference if needed.

Staying calm and proactive is key. Program violations don’t necessarily mean you’ve failed the program, but they do require you to stay on top of your responsibilities.

Tips To Avoid Program Violations

  • Plan ahead if you’re going to drink: Don’t risk it. Arrange alternative transport or stay the night. Even trace alcohol can lead to a failed test.
  • Keep track of service appointments: Missed appointments can be counted as a violation. Set reminders or check your handset (press #1) to stay on track. Your interlock will remind you of your upcoming appointment for the 7 days prior to your appointment time.
  • Follow prompts carefully and respond to all tests: Ignoring or delaying tests, especially rolling retests, can trigger alarms. Stay alert and respond promptly.
  • Use Guardian Interlock’s customer support and resources: Unsure about a message on your device? Contact our customer support. We’re here to help you avoid mistakes before they become violations.
